Market leading DFS operators DraftKings and FanDuel have been allowed to temporarily service consumers in New York as state legislators debate the legal futures of the their business services.
On Wednesday New York Supreme Court Justice Manuel Mendez heard oral arguments defending and opposing DFS services in the state of New York.
Mendez would allow the operators to continue New York services, as they await a legal verdict.
Mendez has informed stakeholders that a decision regarding Attorney General Eric Schneiderman’s injunction on DFS operators would be delivered soon by the Supreme Court.
Both DraftKings and FanDuel have publically stated that they would challenge the injunction, suggesting that Schneiderman opposition towards DFS industry was unfounded as New York internet laws had not changed during the period that the operators have been in service within the state.
DraftKings has further stated that DFS has wrongly been labelled as a “game of chance” by Schneiderman’s office, without any appropriate data, analysis or research.
The operator said in a statement that it “presented compelling evidence that Daily Fantasy Sports competitions are as legal now as they have been for the past seven years that New Yorkers have been playing them. We look forward to Justice Mendez’s ruling.”
